Hatching Egg Terms & Expectations – Breezy Bird Farms
Failure in reading the disclosed policies stated does not transfer responsibility onto the farm. Placing an order means accepting all terms disclosed. Later rejecting or disputing these disclosed terms after the transaction, is not considered grounds to invalidate the original agreement.
Customers purchasing hatching eggs, breeding stock, or developing project lines are purchasing live biological genetics, not manufactured clones. Variation is a normal and expected part of selective breeding projects, especially in developing lines, mixed genetic projects, non-commercial breeding programs, rare varieties, and hatching egg sales. Phenotype variation, color variation, pattern variation, lacing variation, comb variation, hatch variation, growth variation, and quality variation may naturally occur and should be expected within breeding programs and project lines. Do your own research on each individual breed, as some are more developed than others. Product descriptions, listing details, disclosures, photographs, breed notes, and project explanations are provided for customer review prior to purchase. Customers are responsible for reading and understanding listing descriptions before placing an order.
Failure to read listing descriptions, disclosed project information, breed notes, expected variation, or stated policies does not transfer responsibility onto the breeder.
Customers seeking guaranteed uniformity, guaranteed exhibition outcomes, or clone-level consistency are respectfully advised not to purchase hatching eggs or developing breeding projects.
Hatching eggs are a biological product, not a manufactured item.
You are purchasing hatching eggs, not chicks. Chicks are a biological being and not cloned products. Variability is a natural and expected part of incubation, genetics, breeding and biological reproduction.
By placing an order, these terms are acknowledged and accepted in full.
Breezy Bird Farms Customer Conduct Policy
Breezy Bird Farms has implemented stricter customer conduct and communication policies in order to protect business operations, personal wellbeing, and the long-term sustainability of the farm.
Breezy Bird Farms is a physically demanding one-person working farm operation. Daily responsibilities include livestock care, breeding management, incubation, cleaning, feeding, egg collection, packing, shipping, website management, and customer communication. The farm is not staffed as a full-time customer service center. This is a one person operation.
Shipped hatching eggs are not plug-and-play products.
Hatching eggs are a variable biological product that requires research, education, observation, troubleshooting, adaptation, patience, and practical incubation experience. Hatch outcomes are influenced by numerous variables outside the breeder’s direct control, including shipping stress, handling, incubator calibration, humidity management, airflow, temperature stability, climate, storage conditions, seasonal fluctuation, genetics, shell characteristics, and overall incubation skill level.
In some breeding programs, preserving long-term genetic viability and maintaining healthy diversity within a line may also result in occasional trait variation appearing across generations. This may result from selective outcrossing or genetic additions performed either within the current breeding program or by previous breeders and stock sources over time. This had been a normal and responsible practice within serious breeding programs for decades in order to help maintain long term genetic health and viability within a line.
Different breeds and egg types may require different approaches or incubation adjustments for best results. A setup that works well for one breed or line may not produce the same results with another. For example, darker-shelled breeds such as Marans may require different humidity management or incubation adjustments than lighter-shelled breeds or other genetic lines.
Customers are responsible for conducting their own research, understanding the breeds they purchase, monitoring and calibrating their own equipment, developing their own incubation skills, and continuing their own education throughout the hatching process.
Breezy Bird Farms cannot provide individualized incubation coaching, real-time troubleshooting, or one-on-one educational support for every customer, incubator setup, breed type, or hatch scenario.
Unsuccessful hatch outcomes do not automatically indicate breeder fault, infertility, negligence, or product defect.
Communication that consists of any of the following tones of accusations, manipulative, hostility, disrespectful, assumptions, comparisons to unrelated hatch outcomes, predetermined blame, or conclusions presented without openness to documentation review or cooperative discussion may be considered a non constructive communication and may result in closure of the support thread at the farm's discretion.
Claims submitted without documentation cannot be properly reviewed or validated.
Conduct Standards
Respectful communication is required at all times as previously mentioned.
Breezy Bird Farms reserves the right to immediately discontinue communication, deny further support, refuse future service, cancel pending transactions, or permanently decline future business in situations involving:
- Harassment
- Aggressive or abusive communication
- Repeated hostile messaging
- Manipulation tactics
- Intimidation attempts
- Public threats or retaliatory conduct
- Excessive demands after resolutions have already been offered
- Attempts to pressure, wear down, or emotionally exhaust farm operations into additional concessions
- Volatile, inappropriate, or bad-faith behavior directed toward the farm or its operations
Operational Boundaries
Email response times may vary depending on workload, hatch schedules, livestock care demands, shipping volume, seasonal demand, weather conditions, weekends, holidays, or scheduled time away from email communication. BBF reserves the right to limit, reduce, consolidate, pause, or restructure customer communication schedules as needed in order to maintain workable long term farm operations and reasonable service boundaries. This is a physically demanding working farm operating 365 days a year and not staffed or operated as a ful time customer service center.
Response delays do not constitute negligence, abandonment, or failure of service.
Orders will continue to be processed and shipped as scheduled unless otherwise stated.
Agreement to Terms
By purchasing from Breezy Bird Farms, customers acknowledge and accept:
- the inherent variability and risks associated with shipped hatching eggs,
- the educational and experimental nature of incubation,
- and the customer conduct and communication policies outlined above.
Customers unwilling to accept these terms are respectfully advised not to purchase shipped hatching eggs.
No Guarantees
There are no guarantees on hatch rates, fertility, development, or outcome.
Hatch results can range anywhere from 0% to 100%. Average hatch rates are often around 50%, but this is not guaranteed and should not be expected.
Hatching eggs involve natural variability, and outcomes will differ with every hatch.
Fertility Monitoring & Breeding Practices
Breezy Bird Farms actively monitors flock fertility on an ongoing basis.
Eggs are regularly set in incubators to:

check fertility
-
observe development
-
evaluate hatch quality
This is done year-round to maintain awareness of flock performance.
However, fertility can fluctuate due to natural biological variables. Even with consistent monitoring, fertility and hatch success can never be guaranteed.
Understanding Fertility & Early Loss
A fertile egg does not guarantee a successful hatch.
Fertile eggs may:

begin development and stop early
-
fail during incubation
-
fail during hatch
Very early embryo loss can make an egg appear infertile when opened, even though fertilization did occur.
The fertile blastoderm (germinal disc) can be small, difficult to identify, or break down during early development. After incubation, internal structures change and can be reabsorbed, making visual confirmation unreliable.
Cracking eggs open after incubation is not a reliable method of determining fertility.
Egg Appearance, Size & Natural Variation
Eggs from heritage and small-scale flocks are naturally variable.
Eggs may differ in:

size and weight

shape (more pointed or more rounded)

shell texture or thickness
-
color tone or shade
-
surface markings, speckling, or blemishes
These variations are normal and expected.
Egg characteristics are influenced by:

hen age and stage of lay

diet and water intake

environmental conditions

seasonal changes

stress levels

natural hormonal cycles
These are not uniform commercial eggs. Variability is part of working with real animals and does not indicate a defect.
Full Assumption of Risk
The buyer assumes all risk associated with purchasing shipped hatching eggs.
This includes, but is not limited to:

shipping stress, delays, or mishandling
-
rough carrier handling or vibration
-
temperature fluctuations
-
fertility variation
-
embryo loss
-
incubation setup and technique
-
hatch complications
-
post-hatch survival
These variables are inherent and unavoidable.
Shipping, Carriers & Labeling
All eggs are shipped at the buyer’s risk.
Shipping carriers operate through automated systems. Labels such as “fragile,” “eggs,” “do not freeze,” or “do not overheat” do not change how packages are handled.
Carriers are not informed of contents in a way that alters handling.
Shipping Method & No Carrier Refunds
Shipping is arranged through a third-party brokerage system.
Shipping costs are non-refundable under all circumstances.
No refunds are issued for:

delays
-
routing issues
-
weather
-
temperature exposure
No exceptions.
Shipping Distance, Transit Time & Buyer Responsibility
Breezy Bird Farms is located in Manitoba. Transit times vary depending on your location and the shipping option selected at checkout.
Longer transit times will reduce hatch success.
If you are located far from Manitoba or in a remote area, selecting slower shipping options increases the risk of:

reduced hatch rates
-
early development loss
-
decreased viability overall
Buyers are responsible for selecting a shipping method appropriate for their location.
Choosing extended transit times (for example 5 to 10 days) significantly increases risk and is done at the buyer’s discretion.
Upgrading packaging, such as adding liners or additional protection, is strongly recommended for longer travel distances, but does not eliminate risk.
Even with faster shipping selections, delays can still occur due to carrier routing, weather, or logistics.
No refunds, replacements, or credits are provided for delays or extended transit times, regardless of the cause.
Non-Insurable Product (Hatching Eggs)
Hatching eggs themselves are not insurable as a product.
While shipping insurance may exist for parcels, it does not cover:

-
fertility
-
internal embryo damage
-
embryo viability
Carriers do not insure live embryos or hatch outcomes.
All risk related to the eggs themselves is fully assumed by the buyer.
Tracking, Delivery & Retrieval Responsibility
Buyers are responsible for monitoring tracking and ensuring timely receipt.
Once marked delivered, the package must be retrieved promptly.
Packages left unattended may be exposed to:

heat or freezing
-
weather conditions
-
animals (domestic or wildlife)
-
theft or damage
These risks are fully assumed by the buyer. No refunds or compensation will be provided for packages left unattended or exposed after delivery.
Shipping & Transfer of Responsibility
Responsibility transfers once the package leaves the farm.
All conditions after shipment are outside of control.
Seasonal Shipping & Temperature Exposure
Eggs are exposed to changing temperatures during transit in all seasons.
Cold or warm eggs upon arrival are normal shipping conditions.
Post-Delivery Handling & Egg Resting
Eggs should be rested after delivery to allow internal contents to settle.
Recommended resting time:

12–24 hours under normal conditions
-
up to 36 hours after significant transit stress
Failure to rest eggs can negatively affect hatch results.
Buyers are responsible for understanding proper handling and determining appropriate resting time.
Optional Packaging Upgrades
Additional packaging may be available and is optional.
These provide added protection only and do not guarantee results.
Order Quantities
Eggs are sold in set quantities only.
Minimum order for poultry hatching eggs is 12 eggs.
Low quantities increase the likelihood of poor outcomes. This is a numbers issue, not a product issue.
Classroom & School Use Policy
We no longer supply hatching eggs for classroom, school, or project-based use. Orders intended for these purposes are not accepted and will be refunded if placed .
Recommended Order Size
To achieve a more realistic outcome, it is strongly recommended to order 2–4 times the number of birds desired.
ORDER FULFILLMENT & SUBSTITUTIONS
Orders are packed based on availability at the time of collection. Due to the nature of poultry egg production, exact quantities and breeds cannot always be guaranteed on a specific day.If a selected egg is unavailable or compromised (cracked, damaged, or not suitable for shipment), it may be substituted with a comparable egg from the same order where possible. If a suitable substitution is not available, a refund will be issued for the missing egg and the remainder of the order will be shipped as scheduled. Customers are not contacted for substitutions or individual approvals during packing order. Due to the nature of the product timelines are extremely limited.
Orders are not held or delayed to replace individual eggs, as collection and packing follow a continuous process.
Incubation Equipment & Use
Buyers are responsible for proper equipment and use.
Recommended incubators include Borotto, Brinsea, and GQF cabinet models.
However, equipment does not guarantee success. Operator setup, calibration, and handling directly affect results.
Buyer Responsibility & Research
Buyers are responsible for researching incubation, hatching, and chick care before purchasing.
Natural Hatch Outcomes
Losses during incubation and after hatch are normal.
Developmental Variations & Defects
Occasionally, chicks may hatch with physical abnormalities or developmental defects, such as missing features, leg issues, or other irregularities.
These occurrences are a natural possibility when hatching eggs and do not indicate a problem with the breeding stock, egg quality, or flock genetics.
Developmental defects can result from:

incubation conditions
-
temperature or humidity imbalance
-
shipping stress
-
natural developmental variation
When purchasing hatching eggs, a full range of outcomes is possible, including both strong and non-viable chicks.
Assisting Chicks During Hatch
Chicks that are unable to hatch on their own are often not viable.
Assisting chicks during hatch can result in:

deformities (including leg or foot issues)
-
weakness or failure to thrive
-
death after hatch
These outcomes typically occur because the chick was not able to complete the hatch process on its own.
They are not an indication of poor egg quality, fertility issues, or genetic defects, but a result of interfering with a natural process that determines viability.
Chick Care & Veterinary Responsibility
All chick care is the buyer’s responsibility.
Breezy Bird Farms does not provide ongoing care or veterinary services.
A qualified veterinarian must be consulted when needed.
No Returns or Refused Shipments
Refused or returned shipments are not refunded.
No birds, chicks, or live animals are accepted back.
No Refunds, Replacements, or Credits — No Exceptions
No refunds, replacements, or credits are offered under any circumstances.
Communication & Response Times
Questions are welcome; however, buyers are expected to complete their own research before reaching out.
This is a one-person working farm. Daily priorities include animal care and order fulfillment.
Messages are responded to when time allows. Immediate or ongoing support is not available.
Agreement to Terms
Placing an order confirms full acceptance of these terms.
These conditions are final and non-negotiable.
Order Allocation & Final Sale Policy
Hatching eggs are a limited, time-sensitive biological product. Each order is fulfilled from a finite, real-time inventory and is immediately allocated and removed from availability at the time of purchase.
Once an order is placed, it enters processing and cannot be cancelled, modified, or refunded, regardless of shipping status or the timing of customer messages.
Requests to cancel after purchase, including those made before shipment or outside business hours, do not override this policy.
By completing a purchase, the customer acknowledges and agrees to these terms.
Pre-orders/cancellations
We understand circumstances can change. If you wish to cancel a pre-order. The order may be cancelled providing you have not received a processing email. Pre-orders are paid in full upon ordering. A 50% retainer from the order is retained if you wish to cancel. Ordering from our non-preorder eggs is non cancellable.
We use reputable third-party shipping platforms and carriers; carrier selection may change to get your box to you faster. Buyer must be available to receive the parcel (with or without signature). Parcels left outside are at the buyer’s risk. We do not reship for missed delivery, damage in transit, or delays. Address & Contact Details Providing a correct address and email is the buyer’s responsibility. Carriers may return parcels they flag as incorrect. Returned parcels cannot be re-shipped (eggs are time-sensitive). Any return fees billed to the farm may be charged to the buyer. Orders placed with temporary/throwaway emails may be cancelled (vital updates and tracking require a working email).
Photos and Information
All photos on this website is property of Breezy Bird Farms and no permission is given to use any photos for any reason. Any posted information or descriptions are non transferable and sole property of Breezy Bird Farms.
Biosecurity & Final Sale
To protect flock health, all products are final sale. No farm tours or public access to the breeding facility.
Right to Refuse / Fraud Prevention
We may refuse or cancel orders at our discretion (policy violations, biosecurity concerns, suspected fraud, or other reasons aligned with farm values).
Intellectual Property Site content and imagery are the property of Breezy Bird Farms. Do not copy or reuse without written permission. Website Use & Changes This site and its materials are provided “as is.” Policies may be updated at any time by posting revised terms here.
Governing Law These terms are governed by the laws of Manitoba, Canada. Venue and jurisdiction: Manitoba, Canada.
